Terms of Use
These Terms (“Terms”) govern the use of the Swiban Multi-Currency Debit Card (“Card”) and the associated Swiban Mobile App (“App”), issued by Swiban SA, Switzerland (“Issuer”). By activating or using the Card or App, you agree to these Terms.
Definitions
– “Account Holder (AH)” and “Cardholder” means the person to whom the card has been issued.
– “Card Credentials” means the card number (PAN), expiry date, security code (CVC), PIN, and login credentials.
– Fees – charges applicable to the Card and App, as outlined in the fee schedule provided separately.
– “Issuer” means Swiban SA, Switzerland.
– “Mobile PIN” means the confidential code chosen by the AH to access the App.
Card & App Use
2.1 The Card may be used globally at ATMs, merchants, and online platforms that accept Mastercard.
2.2 The App is provided to manage the Card, including balance monitoring, transaction viewing, and security settings.
2.3 The AH is responsible for all transactions made with the Card and through the App.
Mobile App Features
3.1 The AH must activate the App using their Mobile PIN, which must be kept strictly confidential.
3.2 Through the App, the AH can:
a)Activate or deactivate the Card;
b)Enable or disable online usage of the Card;
- c) View balances and recent transactions;
- d) Exchange currencies by buying and selling from available spending limits at the prevailing exchange rates.
3.3 The AH is fully responsible for all actions taken within the App.
Spending Limits & Currencies
4.1 The spending limits can be in multiple supported currencies.
4.2 Exchange rates are those applied by the Card network at the time of the transaction.
4.3 Currency conversion fees may apply where the transaction currency differs from the available spending limits.
Fees
5.1 Applicable fees (e.g., issuance, ATM withdrawals, currency conversion, inactivity, replacement, etc.) will be provided at the time of issuance and are subject to changes.
Security & Responsibility
6.1 The AH must keep the Card, PIN, Mobile PIN, and Card Credentials secure at all times.
6.2 Lost or stolen Cards must be reported immediately.
6.3 The Issuer will not be liable for unauthorized transactions if the AH fails to safeguard their Card Credentials or Mobile PIN.
6.4 If the AH has taken reasonable precautions and unauthorized use still occurs, the Issuer will investigate and may refund amounts in accordance with applicable law and network conditions.
Limits & Restrictions
7.1 Daily and monthly limits on cash withdrawals and purchases apply.
7.2 The Card must not be used for unlawful purposes or prohibited transactions under applicable law.
Expiry & Renewal
8.1 The Card is valid until the expiry date printed on the Card.
8.2 Renewal or replacement may be requested before expiry, subject to applicable fees.
Suspension & Termination
The Issuer may suspend or terminate the Card or App access if:
- The AH breaches these Terms;
- Regulatory or legal obligations require action;
- Fraudulent or suspicious activity is detected.
9.2 The AH may terminate use of the Card or App at any time.
Liability
10.1 The Issuer is not responsible for indirect or consequential losses (e.g., merchant disputes, exchange rate movements).
10.2 The Issuer’s liability is limited to correcting caused directly by it.
10.3 The AH remains liable for all transactions made with the card and mobile app unless reported as lost, stolen, or misused.
Data Protection
11.1 The Issuer processes personal data in compliance with the Swiss Federal Data Protection Act (FADP).
11.2 Personal data may be shared with third parties (e.g.,payment processors and providers , regulatory authorities) strictly as required to provide the service.
11.3 AH have rights of access, rectification, and erasure of their personal data, subject to legal retention requirements.
Dispute Resolution
12.1 In case of a dispute regarding a transaction, the AH must notify the Issuer without undue delay.
12.2 The Issuer will investigate disputes in accordance with applicable Mastercard rules.
12.3 If unresolved, disputes shall be subject to the exclusive jurisdiction of Swiss and Geneva courts.
Compliance & Verification
13.1 The Card and App are subject to Know Your Customer (KYC), Anti-Money Laundering (AML), and Counter – Terrorist Financing (CFT) requirements.
13.2 The Issuer may request identification and supporting documents before, during, or after Card use.
Force Majeure
14.1 The Issuer shall not be liable for failure or delay in performance caused by events outside its reasonable control, including but not limited to natural disasters, strikes, power failures or network outages.
Governing Law
15.1 These Terms are governed by Swiss law and subject to the exclusive jurisdiction of the Geneva courts.
